As a landlord, not only do you have the right to evict tenants who do not pay rent or remain on-site after the foreclosure of the property, but the financial implications usually require that you take appropriate action.

You should expect tenants to follow the terms of your contract to which they agreed. When they don’t, you have the legal right to demand that they leave your property.

The Eviction Process Can Be Complicated

Any tenant who doesn’t pay rent, damages your property, or violates your legal agreement in any way can cause both financial and emotional distress.

Another challenge is that the eviction process can be very complicated. Under the Texas Property Code, there are specific approved ways to provide a tenant with a notice to vacate. A key issue is that if you don’t give the notice exactly as the Property Code requires, then your case can be dismissed by the Justice Court.

You must ensure that the petition is correct, that your application contains the necessary information, and that your evidence is documented properly. Otherwise, if the Justice Court determines that you have not followed the proper procedures, you must start over, beginning with creating a new notice to vacate in order to obtain possession of your property.

Since the pandemic, tenants have become more savvy regarding the requirements on a landlord to successfully prosecute an eviction. Tenants now have greater access to legal representation and therefore landlords also now need their own legal representative more than ever.
